Refund Policy

1. General Terms
Refunds are issued only in the cases set out in this policy.
2. Eligible Refunds
2.1 Formation Refund Promise: If the state rejects your company formation filing, we refund the full amount you paid for your formation order. This includes state filing fees, first-year registered agent fees and any add-ons such as 24-Hour Formation.
This does not apply if the rejection is caused by inaccurate or incomplete information or documents you provided.
State processing times vary. A delay is not a rejection.
This promise covers company formation only. Bank account and payment gateway approvals, including Stripe, are decided by those providers and are not covered.
2.2 Processing Time: Refunds issued within 3 to 5 business days via original payment method.
3. Non-Refundable Cases
- Stripe account denials due to customer's website or business model not being supported
- Bank account rejection due to business or website incompatibility
- IRS or state processing delays caused by US government agencies
- Provided details or documents have mistakes
- Change of mind after processing has started
Partial Refunds: Government filing charges, Virtual Address Fees and Registered Agent Fees are non-refundable except as stated in section 2.1.
4. Dispute Resolution
All claims must be emailed to disputes@bizbirthlk.com within 14 days. Include: order number, detailed explanation, and supporting evidence.
5. Trademark Filings
5.1 Before we file: If you cancel after paying but before your application has been submitted to the trademark office, we refund what has not yet been spent on your behalf, less any work already carried out. Once the Comprehensive Trademark Search has been commissioned, its cost is not refundable, because it has already been performed.
5.2 After we file: Once your application has been submitted to the trademark office, the fee is not refundable. The office fee has been paid, the attorney work is complete, and the outcome rests with the trademark office.
A refusal is not a refund event. Examination is the service working as intended, not failing. Where the refile guarantee in our Terms applies, you receive a further filing with the professional fee waived instead of a refund.
For trademark orders, government fees are never refundable, in any jurisdiction, under any circumstances. This applies to the original filing and to any refile.
If we cannot file at all because of a reason on our side, we refund in full.
5.3 How refunds are paid: All refunds are issued to the original payment method used for the order. Refunds typically take 3 to 5 business days to process, though the time for the funds to appear depends on your bank or card issuer.
